2019 Chicago incident
On January 29, 2019, Smollett alleged that he was attacked in Chicago's Streeterville neighborhood, in what was initially investigated as a hate crime.[31][32] Multiple police sources have informed the media they now believe Smollett orchestrated, or staged, the attack himself.[33]

Smollett told police that he was attacked outside his apartment building by two men in ski masks who made racial and homophobic slurs,[31] and used their hands, feet, and teeth as weapons in the assault.[34][35] According to a statement released by the Chicago Police Department, the two suspects then "poured an unknown liquid" on Smollett and put a noose around his neck.[36] Smollett said that he fought them off. Smollett was admitted to Northwestern Memorial Hospital; not seriously injured, he was released "in good condition" later that morning,[31][37] still early.[38] The police were called after 2:30 AM;[39] when they arrived around 2:40 AM, Smollett had a white rope around his neck.[40]

TMZ reported that sources had told them that the attackers were white, and had said "This is MAGA country", referencing President Donald Trump's Make America Great Again slogan. [41][42] Police representatives initially dismissed both statements[42][43] before subsequently confirming that Smollett had, in a follow-up interview, described that the attackers had shouted "MAGA country" during the assault,[32] something he had not mentioned in the initial interview with police.[40] However, there was no change with regard to Smollett not identifying the race of the attackers (the released initial police report shows no race in the demographics section for either suspect).[34] TMZ wrote that Smollett was doused with bleach, but it was mainly described in news reports as "an unknown chemical substance", as it was in the initial police report.[42] CBS News reported that police officers described smelling bleach on his clothes.[44]

On January 30 some public figures expressed support for Smollett on social media.[32][45] Entertainment industry figures, including Shonda Rhimes and Viola Davis, tweeted their outrage and support.[45] Democratic Senators and candidates for the party's Presidential nominations Kamala Harris and Cory Booker both described the attack as a modern-day lynching,[46] with Booker urging Congress to pass the federal Anti-Lynching Bill he and Harris have co-sponsored.[45][47] In an interview with April Ryan of AURN, President Donald Trump said, "That, I can tell you, is horrible. I've seen it. I think that's horrible. It doesn't get worse."[48]

The Associated Press reported that police had released images of "persons of interest" from surveillance camera footage, but were unable to find footage of Smollett being attacked.[49]

Both Smollett and his manager Brandon Z. Moore told authorities they were having a phone conversation with each other at the time,[50] Moore saying he heard some of what transpired,[51] including "MAGA country", a scuffle, and a racial slur.[51][52] Police have not confirmed Moore's account with phone records.[52] Smollett refused to turn his cellphone over to detectives to allow them to confirm the call.[53] On February 12, 2019, Chicago Police stated that the redacted PDF phone records released by Smollet's team "are not sufficient and do not meet the burden for criminal investigation," and that more cooperation would be required.[54][55][56]

Smollett performed a solo engagement at the Troubadour in Los Angeles on February 2, 2019,[57] although a scheduled meet-and-greet prior to the show was cancelled, citing security concerns.[58]

On February 13, 2019, Chicago Police raided the home of two "persons of interest" in the case. The men are brothers and of Nigerian descent and have acted as extras on Empire. Police recovered bleach and other items from the home and are inquiring if the men know Smollett.[59] The brothers were held in police custody on suspicion of battery but were not charged.[54] According to the brothers' attorney, they know Smollett from working on the show and have also spent time with him at a gym.[54] The two men were arrested after arriving on a flight to O'Hare International Airport from Nigeria on February 13, 2019.[60][61] The two Nigerian men were released February 15 without being charged with a crime,[62][63] with Chicago Police spokesman Anthony Guglielmi stating: "Due to new evidence as a result of today’s interrogations, the individuals questioned by police in the Empire case have now been released without charging and detectives have additional investigative work to complete."[62]

Chicago police later told ABC News: "Police are investigating whether the two individuals committed the attack—or whether the attack happened at all."[64] On February 16, 2019, two Chicago police sources informed CNN that Chicago police had discovered evidence indicating that Smollett had paid the two Nigerian brothers to stage the attack. Financial records indicate that the brothers purchased the rope found around Smollett's neck at an Ace Hardware.[65][66] Chicago police have reached out to Smollett's attorney regarding additional questioning.[67] Chicago criminal defense attorney Michael Monico is representing Smollett.[67] Anthony Guglielmi, spokesman for Chicago PD, tweeted that hoax reports were "unconfirmed by case detectives"[61] and that they had followed up with ABC News, stating that Chicago PD "have no evidence to support [ABC's] reporting"[61] and that ABC's "sources are uninformed and inaccurate".[61]

On February 16, 2019, police sources informed multiple media outlets that they now believe the assault was orchestrated by Smollett. He allegedly agreed to pay the two Nigerian men a sum of money to help him stage an assault. Police confirmed they wanted to speak to Smollett urgently following new evidence provided by the two Nigerian men. Smollett has retained the same defense team defending Michael Cohen.[68][69]
